What is the mandatory minimum DQ period for a first-time drink driving offence in Singapore?
Many drivers are shocked to learn how strict the penalties for driving under the influence truly are. As of the latest guidelines in Singapore, a first-time drink driving offence under Section 67 of the Road Traffic Act carries a strict mandatory minimum disqualification period of 2 years (24 months), alongside hefty fines and potential imprisonment. For repeat offenders, this mandatory minimum shoots up to 5 years.
Will I definitely lose my license if I am charged with dangerous driving, even if no one was injured?
It is a common misconception that if no one was hurt, your license is safe. When determining a DQ period, the court’s most important consideration is protecting the public from dangerous driving. The courts look at the danger you could have posed to the public if allowed to keep driving.
Even if the actual property damage was minor or non-existent, the judge will heavily weigh the potential harm. This potential harm is assessed based on the specific facts at the time, such as road conditions, traffic volume, and your speed and manner of driving. The court will consider your attitude towards other road users. If you display a blatant disregard for the safety of others and a lack of personal responsibility, it is within the public interest to remove you from the roads for a substantial period of time.
In the precedent case of Kwan Weiguang v Public Prosecutor [2022] SGHC 12, an offending driver was involved in a road rage incident. Despite no physical harm being incurred and only vehicle scratches being present, the potential harm to the public was deemed much higher due to his aggressive driving and disregard for safety. Ultimately, the court imposed a 12-month disqualification period.
Can a judge reduce my DQ period if I desperately need my car for work?
Clients often hope that explaining their personal hardships, such as needing to drive for their livelihood or the sheer inconvenience of being banned, will persuade the judge to lower the DQ period. However, the courts have ruled that the primary objectives of imposing a disqualification are punishment, protection of the public, and deterrence.
Furthermore, under Section 43(1)(b) of the Road Traffic Act, if you are disqualified for one year or longer, your license is of no effect and you must pass the prescribed driving tests again. Some drivers try to argue that their DQ period should be kept under 12 months specifically to avoid the burden of retaking these tests. The courts have explicitly stated that this retest is meant to ensure driving competence, not to act as a punishment. Therefore, the inconvenience of hitting the 12-month threshold and having to retake your test is not a relevant factor for the judge to consider when determining the length of your disqualification.
